Legal Globalization and the Challenge to Preserve Pancasila’s Legal Identity
Main Article Content
Abstract
Legal globalization has increasingly transcended national boundaries through the circulation of foreign values, principles, doctrines, and legal norms, particularly through the development of the internet and social media. This phenomenon presents both opportunities and challenges for the existence and Pancasila’s Legal Identity as Indonesia’s distinctive legal foundation, as Pancasila is the Five Principles of Indonesian National Philosophical Ground. This article examines the influence of legal globalization on the existence and Pancasila’s Legal Identity and analyzes strategies for preserving its identity amid global legal developments. The study finds that legal globalization may have positive effects, such as strengthening human rights protection, legal certainty, and justice, but may also introduce values inconsistent with Pancasila. Therefore, strengthening national legal policy through the National Long-Term Development Plan (RPJPN) and the General State Defense Policy, accompanied by Pancasila Screening by Badan Pembinaan Ideologi Pancasila (BPIP), is essential to ensure that Indonesia remains adaptive to global legal developments without losing its national legal identity.
